Sincerity&Food is an online store that promotes and sells the Owner’s products.
CONTENTS SUPPLIED BY THIRD PARTIES
The Owner does not make any precautionary changes to the contents or links supplied by third parties and visible on Sincerity&Food. The Owner is not responsible for said content and their accessibility.
SERVICES SUPPLIED BY THIRD PARTIES
Customers can make use of services and contents on Sincerity&Food supplied by third parties, but they must have read and accepted the third parties’ terms and conditions. The Owner will not be, under any circumstances, held responsible regarding the proper operation or availability, or both, of services supplied by third parties.
CUSTOMER ACCOUNT CANCELLATION AND CLOSURE
Registered Customers can disable their accounts, request their cancellation or interrupt service use at any time through the online store or by the contacting the Owner directly. The Owner, in the event of violation of these Terms, reserves the right to suspend or close a Customer’s account at any time and without warning.
Every order sent constitutes an offer for the purchase of the products. Orders are subject to availability and the Owner’s discretionary acceptance.
The Customer must select the product and check out after having carefully checked and, if necessary, modified the information contained in the order summary. The order is placed by confirming and is subject to the payment of the price, taxes and transportation costs indicated on the order summary form.
The contract is considered fulfilled when the Owner sends the Order Confirmation to the e-mail address supplied by the customer. Then, at the same address, the customer may receive further information regarding the shipment details and a possible tracking number supplied by the courier to monitor the status of the shipment. The Owner reserves the right not to confirm the order, by sending an e-mail to the customer within 5 days of the purchase, informing the customer of the unavailability of one or more of the product purchased. In the case, The Owner will reimburse the price and the shipping costs sustained by the Customer.
Some products may not be purchased on Sincerity&Food. To purchase them, the customer should contact the Owner at the phone number indicated on the product label for further information.
Sincerity&Food uses third party payment systems and does not enter in contact in any way with payment data supplied – like credit card numbers.
The Owner sells only its brand products on Sincerity&Food. The prices, descriptions or availability of the products shown are subject to modification without warning.
The presentation of the characteristics of the products on the data sheets is as detailed as possible. The images and colours of the products on sale may however differ from reality due to various factors among which, by way of example and not limited to, the customer’s monitor, photographic filters, etc. For the reasons described, the customer acknowledges and accepts that said colour differences are not to be considered as lack of conformity of the products.
Execution of Orders
Order will be executed within the period specified on the summary and in the Order Confirmation e-mail, subject to availability of the products ordered.
The Owner will not be held responsible for damages suffered by the customer due to a delay in delivery that is not dependent on foreseeable circumstances at the time of the Confirmation of the Order.
Deliveries will be carried out during normal office hours at the address indicated by the customer and according to the methods specified in the order summary.
Upon deliver, the customer must verify the content and specify any anomalies on the delivery form.
In the event the customer does not collect the package within the period set by the courier, the products will be sent back to the Owner or destroyed; neither the price of the product nor the cost of the shipment will be reimbursed. The Owner will not be held responsible for errors in delivery due to the customer’s incorrect or incomplete information on the purchasing order, for any damages to the product after its delivery to the courier or for delays in delivery caused by the courier.
Upon delivery, the client must check the contents of the shipment and, in the event of anomalies, immediately contact, and in any case no later than 24 hours after delivery, the Owner as per the contact information contained in this document.

RIGHT OF WITHDRAWAL
In the event of the purchase of products or services on Sincerity&Food, the customer has the right to withdraw from the contract within 14 days without indicating why. The withdrawal period expires after 14 days from the day in which the user or a third party designated by the customer – not the courier – takes physical possession of the goods. To exercise their right of withdrawal, customers must inform the Owner of their decision to withdraw through express declaration (withdrawal form) sent to the address indicated below.
If customers withdraws from this contract, they will be reimbursed for all the payments made to the Owner, including delivery costs, if applicable (except for the extra costs deriving from choosing a different type of delivery from the cheapest, standard one offered) without undue delay, and in any case, not beyond 14 days from when the Owner is informed of the customer’s decision to withdraw from this contract. Said reimbursements will be carried using the same method of payment used by the customer for the initial transaction, unless the customer expressly requests otherwise. In any case, the customer will not have to sustain any costs as a result of said reimbursement. The reimbursement can be suspended until receipt of the goods or until the customer provides proof of delivery of the goods.
Customers must ship the goods and have them delivered to the Owner immediately and in any case within 14 days from when withdrawal from this contract is communicated. The term is respected if the customer ships the goods before the 14-day expiry period. The cost of returning the goods will be borne by the customer. The customer is responsible only for the decrease in value of the goods resulting from handling the product in a manner not necessary to establish the nature, characteristics and the functioning of the goods. For further details regarding exercising the right to withdrawal and how to the return goods to the Owner, customers must contact the Owner.
Limitations upon the right of withdrawal of the products
The right of withdrawal is not permitted in the following cases pursuant to art. 59 of legislative decree 21/2014
1. on orders for made-to-measure or customized products made directly with Sincerity&Food and not purchased directly online;
2. on orders for products that can go bad or expire quickly;
3. on orders for sealed products that cannot be returned for hygienic or health reasons or because opened after delivery.
With reference to the above-mentioned exclusion cases of withdrawal, the Customer, in particular, is aware of and accepts that among the products that “risk going bad or expiring quickly” is all types of food with a shelf-life inferior to 6 months in that the characteristics and the quality of these types of products are subject to alteration, even as a result of improper storage. Therefore, for hygienic reasons and customer protection, the right of withdrawal is only applicable on products purchased on the website and which can be returned to Sincerity&Food and resold without endangering customers’ health. In the cases of exclusion of right of withdrawal, Sincerity&Food will return the purchased products to customers at their own expense.
Applicability of withdrawal clauses
The clauses regarding exercising the right of withdrawal and their relative consequences and exceptions shall apply exclusively to customers who do not act in favour of their business and professional activities.
Customers who purchases as a consumer has the right to be guaranteed the conformity of the products and services purchased within the limits laid down by the law and in relation to the type of product. To exercise their guarantee right, the customer must return the products intact.

INTERRUPTION OF SERVICE
The Owner reserves the right to add and/or remove features or characteristics or suspend or totally interrupt the online sales service, either temporarily or definitively. In the event of a definitive interruption, the Owner will do whatever possible to allow customers to remove their information held by the Owner.
RE-SALE OF THE SERVICE
Customers are not authorized to reproduce, duplicate, copy, sell, re-sell or exploit any material or graphic part of the Sincerity&Food store and its services without the Owner’s express permission, guaranteed directly or through a specific re-sale programme.
Customers undertake to keep the Owner (as well as any controlled or affiliate companies, its sales representatives, administrators, agents, licensees, partners and employees) relieved from any obligation or responsibility, including legal expenses to defend themselves, that should arise against damages caused by other users or third parties in relation to contents uploaded online, to violations of the law or the terms of these service conditions.
The service must be used as set out in the Terms. Customers cannot:
1. carry out reverse engineering, decompile, disassemble, modify or create derivative works based on Sincerity&Food or any portion of it;
2. bypass the computer systems used by Sincerity&Food or its licensees to protect the content accessible through it;
3. copy, save, modify, change, prepare derivative works or alter in any way any of the contents supplied by Sincerity&Food;
4. use any robots, spiders, research and/or site location applications, that is any other device, process or automatic means to access, recover, execute scraping or indexing of any part of Sincerity&Food or its contents;
5. hire, fire or sublicence Sincerity&Food product or contents;
6. commit libel, offend, harass, commit threatening acts, intimidate or violate in any way others rights (like the right to privacy and advertisement);
7. publicize or advertise illegal obscene, unlawful, defamatory or inappropriate contents;
8. use Sincerity&Food in any other improper way so as to violate these terms.
INTELLECTUAL PROPERTY RIGHTS
All figurative and word trademarks and all other signs, trade names, service marks, word marks, commercial name, illustrations, images, logos regarding Sincerity&Food are and remain the exclusive property of the Owner or its licensees and are protected by existing trademarks laws and relative international treaties.
Customers must meet minimum age requirements according to the law. Minors can use Sincerity&Food only with the assistance of a parent or tutor. In no case are minors under 13 allowed to use Sincerity&Food.
LIMITATION OF LIABILITY
The Owner, within the limits of the applicable law, is liable for damages of a contractual and non-contractual nature to customers or third parties exclusively when they are an immediate and direct result, wilfully or by gross negligence, of Sincerity&Food activity.
Customers expressly exonerate and relieve the Owner from all responsibility, within the limits of the applicable law, in relation to any of its own or third party damages or demands of any type and kind, including direct, indirect, punitive, accidental, special damages, damages deriving from lost profits, lost revenues, loss of data or replacement costs deriving from or connected with this agreement.
MODIFICATIONS TO THESE TERMS
The Owner reserves the right at any time to modify these Terms, by communicating it to customers through publication on Sinerity&Food or via e-mail.
Customers that continue to use Sincerity&Food after the publication of the modification or receipt of the e-mail accept the new terms without reservation.

Customers may not assign, sub-contract or otherwise transfer any of their rights or obligations under these Terms without the Owner’s consent in writing.

If any provision is deemed invalid, void or otherwise unenforceable, that provision shall be deemed severable form and not affect the enforceability of any of the other provisions of these Terms.
GOVERNING LAW AND JURISDICTION
These Terms and all transactions relating to execution, interpretation and validity of this contract are subject to the law, jurisdiction of the State and exclusive competence of the court where the Owner is located. An exception to this rule applies in cases, where the law provides a sole place of jurisdiction for consumers.
AUTHORITATIVE VERSION OF DOCUMENTS
These Terms have been written and reviewed in the Italian language. Any translations into any language other than Italian are to be considered mere translations. In case of any discrepancy or inconsistency, the Italian language text shall prevail in any event.
ONLINE DISPUTE RESOLUTIONS FOR CONSUMERS

This instrument can be used by European consumers as an out-of-court method to solve any dispute related to and stemming from online sale and service contracts.
